Article 1: object
The purpose of these general conditions is to define the terms and conditions of use of the services offered on the website accessible at the address https://mesures-solutions-expo.fr (hereinafter the “Site”) and such that they are described in Article 4 (hereafter: the “Services”), as well as to define the rights and obligations of the parties in this context. The general conditions of use apply to any variation or extension of the Site on existing or future social networks.
In particular, they are accessible and printable at any time by a direct link at the bottom of the Site's home page.
They may be supplemented, if necessary, by conditions of use specific to certain Services. In case of contradiction, the special conditions prevail over these general conditions of use.
2. Definitions:

- Exhibitor User: refers to legal persons, companies or associations having contracted as exhibitor with the association RESEAU MESURE for the Salon Mesure Solutions EXPO
- Parties: together designate the Exhibitor User and MESURE NETWORK.
- Account: refers to the account that must be created to become an Exhibitor User and access the Services offered by the Site.
- Personal Space: refers to the space on the Account created by the Exhibitor User when registering, allowing him to manage his use of the Services.
3. Operator of the Services
The Services are operated by RESEAU MESURE association governed by the law of July 1, 1901, OJ n ° 20020019 of May 11, 2002, SIREN 444 837 504, located c / o CCI Val d'Oise, 35 Bd du Port - Cap Cergy - 95031 CERGY PONTOISE Cédex (hereinafter, "MESURE NETWORK"). 4. Description of Services
The RESEAU MESURE association is an association under the 1901 law whose activity is the representation of the interests of companies in the measurement sector, the organization of their communication, their training and their events.
RESEAU MESURE offers its Exhibitor Users various Services in connection with the Measurements Solutions EXPO fair, of which it is the organizer. RESEAU MESURE reserves the right to offer new free or paid services on the Site. The Exhibitor User is informed that RESEAU MESURE reserves the right to modify or delete, at any time, without notice and at its sole discretion, all or part of the Services. The description of the Services can be completed on the Site if necessary.
5. Access to the Site and the Services
The Services are accessible, subject to the specific restrictions provided for in these T & Cs and on the Site:
- to any legal person, company or association having full legal capacity to commit to these T & Cs and having contracted with the MESURE NETWORK with a view to the Measurements Solutions EXPO trade fair
hereinafter referred to as “Exhibitor Users”.
The Exhibitor User has access to the Services described on the Site, in a form and according to the functionalities and technical means that RESEAU MESURE deems most appropriate.
6. Acceptance of general conditions
Acceptance of these T & Cs is materialized by a checkbox in the registration form. This acceptance can only be full and complete. It applies concomitantly (i) to the specific conditions where applicable, and (ii) to the confidentiality policy.
Any membership subject to reservation is considered null and void. The Exhibitor User who does not agree to be bound by these T & Cs must not use the Services.
7. Registration on the Site
7.1
Access and use of the Services described in Article 4 requires the Exhibitor User to create an account by registering on the Site, and by completing the form provided for this purpose. The Exhibitor User must provide all the information marked as mandatory. Any incomplete registration will not be validated.
RESEAU MESURE cannot under any circumstances be held responsible for erroneous or fraudulent information communicated by the Exhibitor User.
Registration automatically results in the opening of an account in the name of the Exhibitor User (hereafter: the “Account”), giving him access to a personal space (hereafter: the “Personal Space”) which allows him to manage his use of the Services in a form and according to the technical means that RESEAU MESURE deems the most appropriate to provide said Services.
The Exhibitor User guarantees that all the information he gives in the registration form and / or in his Personal Space is accurate, up to date and sincere and is not vitiated by any misleading nature.
The Exhibitor User undertakes to update this information in his Personal Space in the event of any changes, so that it is always up to date and correct. The information in the “Company Profile”, in their Personal Space, will be used for the Show Exhibitor Guide.
The Exhibitor User is informed and accepts that the information entered for the purpose of creating or updating his Account constitutes proof of his identity. The information entered by the Exhibitor User binds him as soon as they are validated.
7.2
The Exhibitor User can access their Personal Space at any time after identifying themselves using their email address and password.
The Exhibitor User undertakes to use the Services personally and not to allow any third party to use them in his place or on his behalf, except to bear full responsibility.
He is also responsible for maintaining the confidentiality of his email address and password.
Each Exhibitor User is therefore solely responsible for the use of the Services made under his identification. Any connection or transmission of data made using their Account will be deemed to have been made by the Exhibitor User and under their exclusive responsibility.
He must immediately contact RESEAU MESURE at the contact details mentioned in Article 3 hereof if he notices that his Account has been used without his knowledge. It recognizes the right of RESEAU MESURE to take all appropriate measures in such a case, namely:
▪ replace the identifiers of the Exhibitor User Account when there is a risk that they will be used by a third party;
▪ return the newly created identifiers of the Exhibitor User Account in a secure manner.
8. Personal data
In accordance with the law n ° 78-17 of January 6, 1978 relating to data processing, files and freedoms as amended, RESEAU MESURE practices a personal data protection policy, the characteristics of which are explained in a separate document entitled "policy of confidentiality ”. The Parties are expressly invited to read this charter, which can be accessed directly on the Site.
It is recalled here that, in accordance with the law, any natural person has the rights to access, modify, rectify and delete data concerning him. The exercise of these rights is carried out by contacting RESEAU MESURE at the coordinates indicated in Article 3.
The Exhibitor User expressly acknowledges and accepts:
(i) that as part of his registration, the Exhibitor User provides RESEAU MESURE with personal data, which is managed under the “Confidentiality Policy”, in accordance with the legal provisions in force. RESEAU MESURE undertakes to take all reasonable measures necessary to secure and protect the personal data collected and processed by it.
(ii) that the data collected on the RESEAU MESURE Site is evidence of the reality of the operations that have taken place within the framework hereof;
The Exhibitor User can access this data in his Personal Space.
9. Confidentiality and use of Exhibitor Users' information
As part of the use of the Services, RESEAU MESURE undertakes to comply with the legislative and regulatory provisions relating to the personal information of Exhibitor Users, and in particular to respect for privacy.
When the Exhibitor User requests the deletion of his Account, the content of the latter becomes inaccessible, but certain data is kept for statistical purposes, unless the Exhibitor User expressly requests to delete them in accordance with the “Privacy Policy”.
10. Obligations of the Parties
Without prejudice to the other obligations provided for herein, the Parties undertake to comply with the following obligations:
The Parties undertake, in their use of the Services, to respect the laws and regulations in force and not to infringe the rights of third parties or public order.
To. The Exhibitor User is informed and accepts that the implementation of the Services requires that he be connected to the Internet and that the quality of the Services depends directly on this connection, for which he is solely responsible.
b. The Parties are solely responsible for the relationships that they may virtually establish with each other within the framework of the Services. The Parties undertake, in their relations, exchanges and communications to respect the usual rules of politeness and courtesy. A Party whose behavior is found to be contrary to the aforementioned rules of good conduct may be the subject of a decision of exclusion from the Services by RESEAU MESURE, a decision which shall not give rise to any compensation for the benefit of said party at fault.
vs. The Exhibitor User undertakes to provide RESEAU MESURE with all the information necessary for the proper performance of the Services.
d. The Exhibitor User is solely responsible for the name and / or image possibly chosen to identify himself on the Site and which he uses within the framework of the Services (hereinafter referred to as: the “Content”).
The Exhibitor User is thus prohibited from using any Content, in particular and without this list being exhaustive:
- Pornographic, obscene, indecent, shocking or inappropriate, defamatory, abusive, violent, racist, xenophobic or revisionist content,
- Content that threatens the image of a third party, or is likely to infringe the rights of third parties or be detrimental to third parties, in any way and in any form whatsoever,
- Content that is misleading or proposes or promotes illicit, fraudulent or deceptive activities. e. The Exhibitor User acknowledges that the Services offer him an additional but not an alternative solution to the means he already uses elsewhere to achieve the same objective and that this solution cannot replace these other means.
11. Warranty of the Exhibitor User
The Exhibitor User guarantees RESEAU MESURE against all complaints, claims, actions and / or claims that RESEAU MESURE may suffer as a result of the violation by the Exhibitor User of any of its obligations or guarantees under these conditions. general.
He undertakes to indemnify RESEAU MESURE for any prejudice it may suffer and to pay it any costs, charges and / or sentences that it may have to bear as a result.
12. Prohibited behavior
To. It is strictly forbidden to use the Services for the following purposes:
- the exercise of illegal, fraudulent or infringing activities on the rights or safety of third parties,
- breach of public order or violation of the laws and regulations in force,
- intrusion into a third party's computer system or any activity likely to harm, control, interfere with or intercept all or part of a third party's computer system, violating its integrity or security,
- sending unsolicited emails and / or prospecting or commercial solicitation,
- manipulations intended to improve the referencing of a third-party site,
- aid or incitement, in any form and in any way whatsoever, to one or more of the acts and activities described above,
- and more generally any practice diverting the Services for purposes other than those for which they were designed
b. The Exhibitor User is strictly prohibited from copying and / or diverting for their own ends or those of third parties the concept, technologies or any other element of the MESURE RESEAU Site.
vs. Each Exhibitor User undertakes not to provide false personal information on the Site and not to create an Account for another person without their authorization.
d. Each Exhibitor User can only create one Personal Account. The Exhibitor User undertakes to keep his contact details accurate and up to date and to respect the law and good morals.
e. The following are also strictly prohibited: (i) any behavior likely to interrupt, suspend, slow down or prevent the continuity of the Services, (ii) any intrusions or attempted intrusions into MESURE NETWORK systems, (iii) any misappropriation of system resources of the Site, (iv) all actions likely to impose a disproportionate load on the latter's infrastructures, (v) all breaches of security and authentication measures, (vi) all acts likely to infringe the rights and interests financial, commercial or moral of RESEAU MESURE or of the Parties on its Site, and finally more generally (vii) any breach of these T & Cs.
13. Penalties for breaches
In the event of a breach of any of the provisions of these T & Cs or more generally of a breach of the laws and regulations in force by a Party, RESEAU MESURE reserves the right to take any appropriate measure and in particular:
(i) suspend or terminate access to the Services of the Exhibitor User, author of the breach or offense, or who participated in it,
(ii) delete any content posted on the Site, (iii) publish on the Site any information message that RESEAU MESURE deems useful,
(iv) notify any relevant authority,
(v) initiate any legal action.
Any appropriate measure taken by RESEAU MESURE within the framework of this Article cannot give rise to any compensation for the benefit of the Exhibitor User, whatever the possible damage caused by the measure taken.
14. Responsibility and guarantee of RESEAU MESURE
To. RESEAU MESURE undertakes to provide the Services with diligence and according to the rules of the art, it being specified that it weighs an obligation of means, to the exclusion of any obligation of result, which the Exhibitor Users recognize and expressly accept.
Its liability is exclusively limited to the provision of the Services in accordance with the terms described herein, to the exclusion of any service.
b. RESEAU MESURE declines all responsibility in the event of any loss of information accessible in the Personal Space of the Exhibitor User, the latter having to save a copy and not being able to claim any compensation in this regard.
vs. RESEAU MESURE undertakes to carry out regular checks in order to verify the functioning and accessibility of the Site. As such, RESEAU MESURE reserves the right to temporarily interrupt access to the Site for maintenance reasons. Likewise, RESEAU MESURE cannot be held responsible for any temporary difficulties or impossibilities of access to the Site which are caused by circumstances outside it, force majeure, or which are due to disruption of the telecommunications networks.
15. Intellectual property
The systems, software, structures, infrastructures, databases and content of any kind (texts, images, visuals, music, logos, brands, database, etc.) operated by RESEAU MESURE within the Site are protected by all rights. of intellectual property or rights of the producers of databases in force. All disassembly, decompilation, decryption, extractions, reuse, copies and more generally, all acts of reproduction, representation, distribution and use of any of these elements, in whole or in part, without the authorization of RESEAU MESURE are strictly prohibited. and may be the subject of legal proceedings.
The name RESEAU MESURE, logos, designs, stylized letters, figurative marks, and all signs represented on the Site are and will remain the exclusive property of RESEAU MESURE.
No title or right whatsoever to any element of the Site will be obtained by downloading or copying elements of the Site. The Exhibitor User is formally prohibited from reproducing, publishing, editing, transmitting, distributing, showing, removing, deleting, adding to the Site and the elements they contain, any more than modifying them or carrying out any work by taking them. as a basis, nor sell or participate in any sale in connection with the Site or any software relating thereto.
16. Duration of Services, unsubscription, termination
The Services are subscribed for an indefinite period.
The Exhibitor User can unsubscribe from the Services at any time, by sending a request to this effect to RESEAU MESURE by email, to the contact details mentioned in Article 3.
The unsubscription is effective immediately. It results in the automatic deletion of the Exhibitor User's Account and his Personal Space, subject to the stipulations provided for in Article 10.
If Exhibitor Users violate the letter or spirit of these T & Cs, or otherwise create a risk of legal action against RESEAU MESURE, RESEAU MESURE may stop providing all or part of the Services.
RESEAU MESURE will notify the Exhibitor User concerned by e-mail or the next time they log into their Account.
The Exhibitor User can request the deletion of his Account at any time.
17. Amendments
RESEAU MESURE reserves the right to modify these T & Cs at any time.
The Exhibitor User will be informed of these modifications by any useful means.
The Exhibitor User will be informed that the current version is the one posted at the internet address https://mesures-solutions-expo.fr on the date of his access to any of the Services, which The Exhibitor User acknowledges and accepts without restriction.
Any Exhibitor User who uses the Services after the entry into force of the modified T & Cs is deemed to have accepted these modifications.
18. Data Protection Officer
As part of the entry into force of the general data protection regulation n ° 2016/679 of the European Parliament and of the Council of April 27, 2016 which entered into force on May 25, 2018, RESEAU MESURE has appointed a Data Protection Officer. Internal data.
19. Language
In the event of a translation of these T & Cs into one or more languages, the language of interpretation will be the French language in the event of contradiction or dispute on the meaning of a term or a provision.
20. Applicable law and jurisdiction
These T & Cs are governed by French law.
In the event of a dispute as to the validity, interpretation and / or execution of these T & Cs, the Parties agree that the courts within the jurisdiction of the Paris Court of Appeal will be exclusively competent to judge, except for mandatory procedural rules to the contrary. .
21. Entry into force
These T & Cs entered into force on 1er May 2019.
